Terms of Business

Payment
Prior to commencement, a deposit of 50% of the total cost is payable. The remaining 50% will be payable on either completion of artwork or at the estimated project duration limit – which ever comes first. Final payment (including any additional costs incurred) at the project duration limit will be due regardless of the development status. Following this period, we will continue to develop the artwork to completion.
You will be supplied with our electronic banking details on commencement. A notification of your deposit would be appreciated.

Working with Chris Perry Design – your checklist

We have calculated the estimate fee based on our understanding of your project, and of the time and resources required to deliver a brilliant result. Following are some factors from our experience that may influence the final cost outcome.

Images and copy
Where possible, ensure that all images and copy (text) submitted to us are final and have been approved by the relevant parties. In some cases, just a few extra words can necessitate extensive changes to a layout or minor image adjustments which result in more time by us and cost to you.

Timelines and deadlines
Before commencing a project, be as definite as you can about its timing. In cases where you change a project deadline, it may be necessary for us to re-schedule work for other clients and/or work overtime in order to accomodate you. In these instances, extra fees may apply.

Decision-making
We ask that you appoint someone within your organisation to be the final decision-maker. Especially on projects with tight deadlines, it is essential for us to know that we can approach one person for approvals, etc, so we can keep the ball rolling.

Deviations of direction
If any deviation to an agreed progressive direction is requested by you our estimate may need to be revised. You will be advised at the time of request.

Proof checking

Whilst every care will be taken, no responsibility will be accepted by Chris Perry Design for errors found after final proof check by you the client.

Copyright, licensing and ownership of artwork files

1). Contracted work to completion

Subject to written agreement to the contrary, in accordance with the Commonwealth Copyright Act 1968, Chris Perry Design retains ownership of all copyright license in all works prepared by it.
Artwork files, although on completion are provided to clients and suppliers for specified end use, remain the property of Chris Perry Design.
Design/artwork quotes are based on specified use/s by the client at briefing. This secures a limited assignment of the license for the intended purpose. Additional license fees may be required for any part or whole of the quoted design/artwork to be used in further application/s not prepared by Chris Perry Design. Where Chris Perry Design is employed to undertake further applications of original design, no license fee will apply. Work would commence at the normal studio hourly rate.
Assignment of copyright license (which would involve the provision of the artwork and make-up files for unlimited use by the client) may be purchased at a fee half that (ie 50%) of the original artwork/design cost (plus associated handling fees).
Material such as photographs and illustrations that have been licensed for specific use in the artwork also remain the property of that originator (unless designated otherwise) where terms and conditions also may apply.

2). Ideas & concepts – confidentiality

The ideas and concepts developed by Chris Perry Design and embodied or summarised in visuals and/or written documentation provided to the customer remains the confidential information and intellectual property of Chris Perry Design. In the event that the customer does not ultimately accept a quote from Chris Perry Design or a contract is not ultimately concluded between the customer and Chris Perry Design then the customer will have no right to use any such confidential information or intellectual property.

Goods and services Tax (GST
)
Within Australia: In accordance with the Federal Government ruling a 10% GST (Goods and Services Tax) will be added to all invoices. Overseas clients should consult their accountants.
